Terms of booking and guidelines for cancellations

These terms of travel apply to Turisthus Nord F.M.B.A. as a facilitator and you personally, or by means of a different agreement with the business, according to what appears from the confirmation.
If you book a package travel – defined as a package of travel services, which have been put together beforehand by Turisthus Nord and are offered at an aggregate price and clearly presented as a ‘package travel’ (‘pakkerejse’) – please refer to our Conditions for Package travels (see below).
If you wish to buy a gift voucher, the conditions at the bottom of this page apply.
 
TERMS OF BOOKING applicable to:


ACCOMMODATION, ACTIVITIES AND OTHER TOURISM PRODUCTS
(Offered as single product and not part of a package travel)


1. PRICES
Prices on the website are in Danish kroner (DKK) unless specifically stated otherwise.
We reserve the right to make changes due to movements in prices and exchange rates outside of our control after this date.

2. WHEN IS MY BOOKING BINDING?
The purchase/booking is binding to you as soon as it is confirmed in writing by Turisthus Nord. These conditions are applicable from this moment, regardless of whether you have made a full or partial payment or not yet made a payment. Turisthus Nord is only a facilitator of the services purchased, for which reason the provider of the services is the party responsible for any shortcomings. Different terms of cancellation might apply within the same product category, so please make sure to check the conditions of the specific booking carefully.
Please note that Turisthus Nord is not bound by the agreement until you have received our confirmation of acceptance. Turisthus Nord is not responsible for errors in prices stated, website not being up to date or services being sold out/discontinued. The website is not to be considered a binding offer from Turisthus Nord.

3. WHAT, WHEN AND HOW DO I NEED TO PAY?
Payment is made according to the terms at the time of booking, both via telephone and online, and only by means of credit card. We apply Secure Socket Layer (SSL) technology to protect and encrypt your credit card details when this information passes through our system.
Please note that refunds are not always available in connection with special offers and prices. Please make sure to check room and price information carefully before booking.
For refunds via invoice, a fee of DKK 150 will be charged.

4. CANCELLATION INSURANCE
Turisthus Nord offers travel insurance providing coverage for illness prior to the trip. This comprises 6% of the price of the booking and can be chosen as an option during purchase.  
 
5. TRAVEL INSURANCE
Participation is at your own risk and no form of insurance during the trip is included. Turisthus Nord refers to Gouda Travel Insurance for buying insurance after booking the trip.
 
 6. CANCELLATION COSTS
Cancellation not covered by the cancellation insurance can be made following these rules:
If you wish to change or cancel your booking, you must follow the directions in the confirmation email.
The following fees are applicable in connection with cancellation, unless otherwise described in your confirmation:
Cancellation or changes to a single hotel room, Bed & Breakfast room:
Unless otherwise specifically stated in the booking confirmation you received via email, any cancellation or change must be made no later than 12.00 pm on the day before arrival. In case of cancellation or change later than 12.00 pm on the day before arrival, the forthcoming night will be charged. In case of non-appearance without cancellation, 100% of the price of the booking will be charged, so please do not forget to cancel in case you are prevented from appearing.
Special terms of cancellation or changes might apply in connection with certain offers or discounts, which will also appear from your booking.
Cancellation or changes to a single hostel room:
Any cancellation or change must be made no later than 7 days prior to arrival. In case of cancellation or changes later than 7 days prior to arrival or in case of non-appearance, 100% of the price of the booking will be charged.
Special terms of cancellation or changes might apply in connection with certain offers or discounts, which will also appear from your booking.
 Cancellation and changes to holiday homes, cabins and apartments:
Any cancellation or change must be made no later than 45 days prior to arrival. In case of cancellation or changes later than 45 days prior to arrival or in case of non-appearance, 100% of the price of the booking will be charged.
Special terms of cancellation or changes might apply in connection with certain holiday homes, cabins and apartments or in connection with offers or discounts. This will appear from your booking.
Cancellation and changes to camping:
Any cancellation or change must be made no later than 30 days prior to arrival. In case of cancellation or changes later than 30 days prior to arrival or in case of non-appearance, 100% of the price of the booking will be charged.
Cancellation or changes are not available in connection with certain offers or discounts. 
Cancellation and changes to activities, events, tickets or transport:
Cancellation or changes not possible, unless otherwise described in the booking confirmation.
Cancellation – general terms
Cancellations and changes are made online at book.toppenafdanmark.dk. You will find your booking under ‘My page’. If you are experiencing issues completing your cancellation or change, please contact booking@toppenafdanmark.dk and you will receive a confirmation of your change within 24 hours.
A refund is not guaranteed if cancellation was made via the accommodation provider, who will therefore refer you to Turisthus Nord.
Please note that your cancellation is not valid until you have received a written confirmation of your cancellation from Turisthus Nord.
Please note that certain discounts or offers cannot be changed or cancelled. Refunds will not be available in case of non-appearance (‘no-show’). Fees for making changes, invoicing and cancellation will not be refunded. Unused tickets and the like must be forwarded as soon as possible.


Additional bankruptcy protection – LINKED TRAVEL ARRANGEMENTS
In certain circumstances, a linked travel arrangement can be established through the travel services ordered by you.
If you order several separate travel services relating to the same purpose of travel during the same visit in the booking portal (the website) or within 24 hours from the first booking – and the supplementary service makes up more than 25% of the total price paid, then the travel services become part of a linked travel arrangement. In that case, Turisthus Nord f.m.b.a., as required by EU law, has set up protection via the Danish Travel Guarantee Fund for the refund of your payments to Turisthus Nord f.m.b.a. for services not delivered in consequence of the bankruptcy or insolvency of Turisthus Nord f.m.b.a.
Note: This will not ensure a refund in the case of the bankruptcy or insolvency of the relevant provider of services (e.g. if the accommodation provider or the activity provider goes bankrupt).
Note: A linked travel arrangement does not give you the same expanded possibility for cancellation as is the case when ordering a packaged tour/package travel, which has been put together beforehand. Cancellations are subject to the above conditions.
If you, after having decided on and paid for a travel service, order additional travel services for your travel or holiday by way of this booking portal, you are not covered by the rights applicable to package travels according to Directive (EU) 2015/2302. Thus, Turisthus Nord f.m.b.a. will not be liable for the correct delivery of these additional travel services. This means that all additional orders are subject to the conditions for the chosen products.
 
7. COSTS FOR MAKING CHANGES
In some cases you have the option to make changes to your booking for a fee. The fee for making a change is fixed at DKK 100. If the price of the service has risen in the meantime, we will calculate a new total price.

8. COMPLAINTS
Any complaints must be directed to the party responsible for the product, for example the hotel manager/head of the golf course, etc., or their representative, as soon as possible. You will lose the right to file a complaint if you do not notify the local product provider. If you leave the place of accommodation, the golf course or the event without giving the organizer reasonable time to solve the issues, you will lose the right to compensation. Any claims for compensation must be in Turisthus Nord’s possession no later than 30 days after the end of the trip.

9. CONTRACTUAL BASIS
Group travel and special arrangements are not covered by the present rental conditions as there are special laws of contract in force for these types of travel. For all other reservations, the above general terms and conditions apply, unless special terms are specified in the reservation. Turisthus Nord is not responsible for misprints and omissions in printed and electronic material, such as brochures, internet pages, etc.

10. GENERAL DATA PROTECTION REGULATION (GDPR)
Turisthus Nord F.M.B.A. processes the personal data you provide to us. Personal information that will be processed include, but are not limited to, name, date of birth, sex, address, email address and telephone number. We can also process information recorded in connection with an order, such as age, special dietary requirements. You submit the personal data yourself when setting up payments arrangements, creating an account or other services on the web or via telephone.

 CONDITIONS FOR PACKAGE TRAVELS
 
Turisthus Nord F.M.B.A. is responsible for the booking on this website and is the provider of the package travel. Turisthus Nord is therefore responsible for the delivery of the service, and any inquiries regarding the Package travel must be directed to Turisthus Nord.

4. PROTECTION VIA THE DANISH TRAVEL GUARANTEE FUND
Turisthus Nord F.M.B.A is registered in the Danish Travel Guarantee Fund with no. 3333 and complies with all mandatory requirements for collateral and financial security.
When the combination of travel services offered to you constitutes Package travel, cf. Directive (EU) 2015/2302, you will be covered by all EU rights for Package travel. Turisthus Nord F.M.B.A. is fully responsible for the correct delivery of the overall Package travel product.
Furthermore, Turisthus Nord F.M.B.A. has taken steps to set up statutory protection for the refund of your payments and, if the Package travel includes transport, to ensure your repatriation, in the event of bankruptcy or insolvency of the provider(s).
Central rights under Directive (EU) 2015/2302
Prior to entering into the travel agreement, you will receive all important information about the Package travel via Turisthus Nord F.M.B.A.’s website. Turisthus Nord F.M.B.A. is responsible for the correct delivery of all the travel services included in the agreement.

5. INSURANCE
We offer cancellation insurance providing coverage for cancellations in case of illness prior to the trip. The price of the insurance is fixed at 6% of the total value of the booking. 
Travel insurance: Participation is at your own risk and insurance during your stay is not included. Turisthus Nord refers to Gouda Travel Insurance for buying insurance after booking the trip. 

6. CHANGES AND CANCELLATION
Changes to your trip:
In some cases, you have the option to make changes to your booking for a fee. The fee per change is fixed at DKK 100. If the price of the service has risen in the meantime, we will calculate a new total price.
You can transfer the Package travel to another person no later than 7 days ahead of the date of arrival, which may be subject to payment of any additional costs. You will be charged a change fee of DKK 100. Changes can be made online or by contacting customer service at booking@toppenafdanmark.dk or by telephone +45 98 44 13 77.


The price of the Package travel can only be increased in case of increases in certain costs (e.g. fuel prices) and if this is explicitly stated in the agreement, and under no circumstances later than 20 days prior to the start of the Package travel. If the price increase exceeds 8% of the total price of the Package travel, the traveller can terminate the agreement. If the travel organizer reserves the right to raise the price, the traveller will have a right to a price reduction in case of a fall in the price of the relevant costs.
In the event that, subsequent to the start of the Package travel, substantial elements of the Package travel cannot be delivered as agreed, you will be offered reasonable alternative arrangements without any additional cost to you.

Cancellation
You can cancel the agreement without the payment of a cancellation fee and receive a full refund for all payments made if any substantial elements of the Package travel, except for the price, is changed substantially. In the event that, subsequent to the start of the Package travel, substantial elements of the Package travel cannot be delivered as agreed, you will be entitled to reasonable alternative arrangements without any additional cost.
You can terminate the agreement without paying a cancellation fee, prior to the start of the Package travel, in case of extraordinary circumstances, for example if there are serious safety concerns at the destination, which are likely to have an effect on the Package travel. The extraordinary circumstances must have arisen or been aggravated substantially following the conclusion of the agreement.
Furthermore, at any time prior to the start of the Package travel, you can terminate the agreement for a reasonable and justifiable cancellation fee (see section on fees – package travel).
FEES for cancellations not due to illness or extraordinary circumstances
Accommodation:
Fees for cancellation of accommodation follow the agreement we have made with the accommodation provider and will vary according to accommodation type, period and price campaign.
When selling accommodation in connection with package travel, Turisthus Nord has a limited right of cancellation with its providers, for which reason your right of cancellation does not differ from the one that exists between Turisthus Nord and our providers. Thereby, in the event that you cancel for a fee, Turisthus Nord will not obtain any income by selling the activity/accommodation to someone else.
For detailed information on the cancellation of your specific package, please follow the information in you booking confirmation.
Admission fee / activity / ticket:
Concert tickets, festival tickets or tickets for other date-specific events cannot be cancelled. This is owing to our terms with the provider. 
Other activities and admission tickets follow the terms of cancellation from the individual provider, as specified in your booking confirmation.
You can terminate the agreement without paying a cancellation fee if services are not delivered in accordance with the agreement and this substantially affects the delivery of the Package travel, and we fail to remedy the issue.
You are also entitled to a price reduction and/or compensation if the travel services are not delivered or are delivered inadequately.

7. PROTECTION IN CASE OF BANKRUPTCY
In the event of our bankruptcy or insolvency, payments will be refunded. In the event of our bankruptcy or insolvency subsequent to the start of the Package travel, and if the Package travel includes transportation, your repatriation is ensured.  Furthermore, Turisthus Nord F.M.B.A. has set up bankruptcy or insolvency protection with the Danish travel Guarantee Fund – Haldor Topsøes Allé 1 • 2800 Kongens Lyngby • Company registration number (CVR): 86484218.

8. COMPLAINTS
Turisthus Nord is the organizer of the package travel, and all inquiries as well as any complaints must therefore be directed to Turisthus Nord.   
You will lose the right to file a complaint if you do not notify Turisthus Nord without undue delay after having realized the shortcoming. If you leave the place of accommodation or the event without giving the provider or Turisthus Nord reasonable time to solve the issues, you will lose the right to compensation. Any claims for compensation must be in Turisthus Nord’s possession no later than 30 days after the end of the trip.
If you are dissatisfied with your hotel room or the product delivered to you, you are also welcome to sort out the issue with the provider on-site. Often, they will be able to help you and solve any issues and misunderstandings immediately. This will save you the trouble of initiating a complaints process.

Conditions of sale for GIFT VOUCHERS
Gift vouchers are sold at any value and can be used for purchasing products found across book.toppenafdanmark.dk
Gift vouchers are valid for 36 months after the date of issue. Any residual cash value of a gift voucher can be redeemed up to one year after expiry, which will be subject to a fee of DKK 50 charged out of the residual value.
The gift voucher can only be redeemed in connection with the purchase of products – including e.g. package travel, accommodation, activities and event tickets – and can thus not be used for the purchase of additional gift vouchers. If the value of the gift voucher does not suffice for the order you wish to place, the difference can be paid by means of one of the accepted methods of payment. Gift vouchers and any outstanding amount in your favour can only be redeemed prior to the completion of your order.
The gift voucher cannot be used for the purchase of goods with our providers at their physical locations.
In the event that an order paid for by means of an outstanding amount or a gift voucher is cancelled, this outstanding amount will be issued as a new gift voucher and will thus not be paid out in cash.
In accordance with Danish law, you have the right to cancel your purchase of a gift voucher within 14 days of purchase. If you wish to exercise this right, please contact booking@toppenafdanmark.dk
All bookings made with the use of a gift voucher follow the applicable business conditions for the product.
